| Copyright question dealing with celebrities? I'm wondering how the copyright laws would work in this situation. And if celebrity faces are considered copyright? I have an idea for a gag gift to make for someone that involves a celebrity. The gift is not going to be sold, nor will I make any profit from it, and only one copy would ever be made, just a gag gift for a friend. This example I'm about to give is not the actual idea, but a similar one for the sake of this question. I could make some muscular padded arm sleeves, and call them Arnold Schwarzenegger arms. They would be in a package that actually has pictures of Arnold Schwarzenegger, with little words saying "now you can be like me", or something like that. Now the reason I wonder about the copyright law for something like this is because the idea is so funny, that I know the person will show the gift to others, and I also would like to post a video of my creation on youtube or something, and obviously don't want to get into any sort of copyright mess. I'm not quite sure where copyright laws fall involving celebrity faces, since afterall, you always see celebrity impersonators doing all sorts of things I'm sure they didn't have permission to do, or you see gossip magazines and paparazzi always posting pictures of celebrities, even with wild accusations, etc. So is using a celebrities face on a gag gift considered perfectly OK? And if not, what are the minimum amounts of changes that could be made to make this ok? Perhaps just blurring the celebrities face slightly, enough that it could be claimed as a different person who is simply a similar likeness, with the same name? |
| Copyright covers people creations. Someone's face wouldn't be covered by copyright. Although people are entitled to their privacy and using someone's image without their permission would be considered an invasion of privacy. Where copyright issues would come into play with regards to pictures of celebrities is that the photograph is considered the creation of the photographer. Those paparazzi photographers in turn sell the rights to their 'creation' to the tabloid magazines/websites/television. So if you pull the image off of someone's website, you're likely violating that websites copyright of the photograph. An exception to copyright protection is when a use is determined to fall under the category of Fair Use. Doing a parody of something likely qualifies as Fair Use. Most of that information is just provided for academic purposes. If you're just making one of these and using it as a gag gift, you're not likely to get into any trouble. |
